Whether this Court has the power to issue a Writ of Certiorari to review the action of the Fifth Circuit Court of Appeals in declining to allow an appeal to it, under 262 of the Judicial Code, 28 U.S.C. 377. United States, 319 U.S, 38. (2.) Ifit has, whether it may review the merits of the decision of the Court. (3.) Whether the Circuit Court erred in not issuing COA to it.
