Rucho, 318 F. Supp. 3d 777, 799 (M.D.N.C. 2018), cert. granted, 138 S. Ct. 923 (2018) (No. 18-422) and Benisek v. Lamone, No. 1:13-cv-03233-JKB, 2018 USS. Dist. LEXIS 190292 (D. Md. Nov. 7, 2018), cert. granted, 202 L.Ed.2d 510 (U.S. Jan. 4, 2019) (No. 18726), where i) the issues before the Court in Rucho and Benisek are applicable, instructive and dispositive to the present case, ii) trial in the instant case is set to begin on February 5, 2019, and 111) this Court has ordered expedited consideration of threshold jurisdictional issues in Rucho and Benisek that are dispositive to the instant case.
