Question Presented (AI Summary)

Whether Petitioner's rights under the Fourth Amendment were violated when the government used misleading information to seek a warrant for evidence it already had and concealed this information from the magistrate issuing the warrant

Question Presented (from Petition)

question presented is as follows: Whether Petitioner’s rights under the Fourth Amendment were violated when the government used misleading information to seek a warrant for evidence it already had and concealed this information from the magistrate issuing the warrant. Because the proper application of the Fourth Amendment and the good faith exceptions applied in Krull and Leon are of exceptional importance to the administration of justice in federal criminal cases, this Court should grant certiorari in this case to decide this question and, and upon review, should reverse the judgment of the Fifth Circuit.
