QUESTION PRESENTED FOR REVIEW Whether the decision of the United States Court of Appeals for the Fifth Circuit (“Fifth Circuit”)-which held Mr. Brown was involved with drug trafficking, as opposed to drug possession, and thereby enhancing his Guidelines range under U.S.S.G. § 2K2.1(b)(6)(B) for gun possession in connection with a felony--conflicts with the decisions of other Circuits on an important matter, and therefore the decision by the Fifth Circuit calls for an exercise of this Court’s supervisory powers such that a compelling reason is presented in support of discretionary review by this Honorable Court.
