Application (19A1042) denied by Justice Alito. The application for a stay is denied because there is not a fair prospect that the Court would grant the petition for a writ of certiorari. The petition seeks review of the Pennsylvania Supreme Court’s summary refusal to exercise its discretionary “King’s Bench” authority to hear certain matters that did not originate in a lower court. The petition raises constitutional questions relating to a situation that appears to be uncertain and subject to change, namely, the restrictions being imposed on persons wishing to engage in constitutionally protected activities in groups and in public places. Denial of the application should not be interpreted as an expression of any view on claims regarding the constitutionality of the state executive regulations imposing COVID-related restrictions, or claims of selective enforcement based on viewpoint.
