That causes the innocent person to be arrested for then indicted on the aggravated robbery charge, put thru hearings, then trial by the court found guilty of the charged offense and ordered incarcerated pursuant to the trial courts judgment. Thereafter, the now convicted (but innocent ), person attacks the judgment collaterally attempting to vacate it, setting forth the illegally withheld and omitted evidence that proves there actual ~ innocence, and proves the illegal use of perjury by-way of the alleged victim own recantation conceding in open court the aggravated robbery was not committed or even attempted. But the State’s Courts refuses to adjudicate the merits. QUESTION’S PRESENTED Whether perjury has amounted to and causes one or both.
