QUESTION PRESENTED 1) Whether Petitioner was deprived her constitutional right affording her due process when the Virginia Supreme Court and the Virginia Court of Appeals by upholding the Dickenson County Circuit Court’s decision which deprived Petitioner of her due process when the Circuit Court denied Appellant’s appeal for not being timely and therefore denied Appellant the protections of counsel afforded her under Va. Code § 16.2-266(D)(2), the Virginia Constitution and the United States Constitution to have a prepared attorney to represent her before the state terminated her parental rights. 1
