QUESTION PRESENTED I. WHETHER THE EIGHTH CIRCUIT'S CONCLUSION THAT MR. ROSS DISTRIBUTED THE CONTROLLED SUBSTANCE THAT RESULTED IN THE DEATH OF K.P. IS INCONFLICT WITH THIS COURT'S DECISION IN BURRAGE, THE REQUIREMENT FOR THE GOVERNMENT TO SHOW BUT-FOR CAUSATION, AND CASES FROM OTHER CIRCUITS, WHEN THERE IS NO EVIDENCE THAT MR. ROSS DISTRIBUTED THAT SUBSTANCE AS THE SUBSTANCE HE DID DISTRIBUTE CONTAINED FURANYL FENTANYL AND NO FURANYL FENTANYL WAS FOUND IN K.P.'S BLOOD OR URINE? ll
