QUESTION(S) PRESENTED : Whether the State of Massachusetts has authority to abrogate a citizen’s Constitutional rights under the 14th Amendment Due Process by depriving the citizen of timely notice and an opportunity to be heard on matters affecting the person, life and property interest of the citizen, absent extraordinary circumstances? Do judiciary proceedings and judgments in the State of Massachusetts serve to oppress citizens by denying them of their 14th Amendment Equal Protection rights; leaving them without any remedy which would place injured citizens in the position they would have been in had the wrong not occurred, further denying them the right to be heard by an impartial and unbiased court? Should the judgment of a Massachusetts Court of appeals in a medical malpractice case be null and void when an abusive Independent Medical Examiner who is subject to . HIPAA, and other laws regulating the practice of medicine is found to be absolutely privilege, whereas parallel courts in other states hold that an IME owes a duty to do no harm during examination?
