QUESTION(S) PRESENTED No sworn affidavit from a victim, no evidence of a crime, no 2 witnesses to a crime. 4th amendment is clear. NO IMMUNITY | FRCP RULE 12 A (i) states a party has 21 days to respond and the defendants responded 40+ days later. AGAIN. COURTS REFUSE TO FOLLOW THE RULES FRCP 55 b (2) The court may conduct hearings or make any federal statutory right to a jury trial—when, to enter or effectuate judgment, it needs to: | (A) conduct an accounting; | . | (B) determine the amount of damages; | (C) establish the truth of any allegation by evidence; or (D) investigate any other matter. Has Congress or the Supreme Court given any court in America the authority to investigate crimes? Resounding NO. Can lower courts set their own precedent? Does the 3rd circuit court of appeals have the power to extend the duties and powers of state judges to include investigating crimes? Do judges have immunity when committing perjury while wearing the robe? Did Judge Paul Matey violate due process by failing to recuse himself from this claim? Are lower court orders void when they are issued by judges rule on behalf of their friends, violate due process and refuse to follow FRCP? Are the courts disqualified because of bias or appearance of bias arising from the alteration of court records, dockets, and ex parte communications? Did the district court violate due process or act in excess of its jurisdiction by acting on its own motion to grant relief that was not requested and to dismiss actions summarily in favor of defendants who didn’t file a timely response per FRCP 12 (a) (A) (i)? Was judge Paul Matey required to recuse himself when he was a witness in this case, had first hand knowledge of Defendant Andrew Carey criminality, pattern of official misconduct and had a close personal relationship with the defendant Marcia Silva in this proceeding? Did the district court violate due process by closing the case rather than schedule a hearing to atlow me to provide additional evidence proving lack of probable cause when | requested a default judgment against the defendants per FRCP 12 (a) (A) (i)? Does the defendant's ex parte contacts between defendants, lawyers and judges, create the appearance of bias or partiality requiring recusal and disqualification of judge Paul Matey and others? Did the lower court violate due process by affirming judgments in favor of the State of New Jersey defendants on their own without notice? Does judicial immunity protect judges or other judicial personnel who have conflicts of interest, or bias and misused judicial power to conspire with interested parties in altering court records and other government records? Does federal law prohibit aiding and abetting violations of due process and violations by judges acting notwithstanding conflicts of interest? Does the state of New Jersey have a signed affidavit from a complaining witness whom I’ve harmed or whom I’ve harmed their | property? : | Does the defendant have probable cause for an arrest? Do the defendants have evidence of a crime? Defendants didn’t have it in | discovery because it never existed. | Did the judge who approved the warrant for my arrest meet the burden of proof showing probable cause in order for me to be arrested? Nothing was provided in discovery.
