Did the Third Circuit err when, in conflict with this Court, it held that Petitioner failed to “make a substantial showing of the denial of a constitutional right,” while applying for a certificate of appealability, necessary to be granted before an appeal, by abusing its discretion in District Court’s denying his requests for ALL and ANY case-related legal materials ? 2. Did the Third Circuit err when, in conflict with this Court, it denied Petitioner’s request for a certificate of appealability by ignoring the fact that the avenue of his established appellate review, directly or collaterally, is NOT kept from unreasoned distinction? 3.
