QUESTIONS PRESENTED The questions presented are: : Whether the Fourth Amendment assures parents that, in the absence of parental consent or judicial authorization, painful and medically unnecessary : procedures of their child will not be undertaken for investigative purposes at the behest of state officials. Whether the Fourth Amendment assures parents that their children will not be seized by state officials from a location where the family has a reasonable expectation of privacy, without exigent circumstances or judicial authorization. Whether the Fifth Amendment prohibits state officials from using fabricated evidence and perjury and prohibits the destruction of evidence in a proceeding where governmental action infringes on the sanctity of a family. i
