June 12, 2023: Florida Supreme Court disposition denying discretionary review of the Third District Court of Appeal’s orders dismissing the appeal and denying a motion for rehearing with suggestion for rehearing en banc. See Exhibit A (Original Order and Third District Court of Appeal’s Orders) and Exhibit B (Florida Supreme Court’s Disposition). b. September 11, 2023: Expiration of time to file petition for a writ of certiorari in this Court, unless extended. This case presents a question of great importance: whether Florida state courts can deprive any person of property, without due process of law, or deny to any person the equal protection of the laws, by deciding the question of a foreclosure plaintiffs lack of standing to invoke the subject matter jurisdiction of the state court in conflict with decisions of this Court and the Florida Supreme Court. The shocking disregard for Stare Decisis in the Florida courts on this issue should be addressed by this Court. Petitioner recently moved to Uruguay in July due to his 84-year old mother’s deteriorating health. Petitioner never had the privilege of attending a U-S. law school, and has minimal experience with civil cases. Petitioner earns subsistence income and his other work commitments render him unable to dedicate the necessary time to draft an intelligent petition and file the forty (40) booklets containing his petition on or before the current filing deadline of September 11, 2023. After receiving notification of this motion, MTGLQ INVESTORS, L.P., through its counsel, Steve D. Tran, Esq., advised that it is apposed to the extension of time. WHEREFORE, Petitioner respectfully requests a 60-day extension of time to file his petition for a writ of certiorari from the Florida Supreme Court’s disposition.
