The divided panel of the Ninth Circuit upheld summary judgment against Petitioner on a developed record and diverged from the consensus of other Circuits. 6. Petitioner respectfully requests an extension of time to file a petition for writ of certiorari. Following denial of the petition for rehearing en banc, Petitioner engaged additional, specialized counsel who were not previously involved in the case. A 60-day extension would allow counsel sufficient time to fully examine the decision’s consequences, research and analyze the issues presented, and prepare the petition for filing. Additionally, the 60-day extension is necessary because of the press of counsel’s other pending litigation matters. For the foregoing reasons, Petitioner requests that the time within which she may file a petition for a writ of certiorari in this matter be extended for 60 days, to and including October 20, 2023.
