This Petition presents the question of whether state law supersede s the federal substantive law of res judicata in deter mining whether a federal final judgment is binding as res judicata in state court. Departing from this Court’s precedent, and in conflict with both federal circuit courts and other state appellate courts , the Second District Court of Appeal of Florida affirmed a state court’s refusal, on state substantive law grounds, to apply federal substantive law of res judicata in determining whether a federal final judgment was binding in state court .
