Whether a state court's child custody determination violates due process and jurisdictional requirements when modifying an out-of-state emergency order of protection without a hearing and potentially facilitating parental kidnapping
Question(s) Presented 1.) Is the Illinois trial courts judgment, dated 02/25/2022, valid, if due process, equal protection, and/or jurisdiction is absent for the duration of the case? 2.) If Illinois law states that an Exparte/emergency order of protection (OP) is to be held for at least three days, but the IL State Court voids the OP in less than ; three days, would an OP still be valid? : Would an entered Court order be void or invalid that prematurely ended an OP less than three days? 3.)
