Whether Pennsylvania's appellate procedures and waiver doctrines violate the Equal Protection and Due Process Clauses of the Fourteenth Amendment by disproportionately dismissing appeals and suppressing citizens' rights to judicial review
1. Whether a state may constitutionally guarantee rights to appeal in all cases, then suppress that right by rigidly and/or arbitrarily applying procedural technicalities that disproportionately affect the citizens of the state, especially pro se litigants and criminal defendants ’ right to appellate review, and whether such a dismissal rate, at an average of 55% which is substantially higher than that of neighboring states at an average of 16%, and all other states in the United States significantly, as in case of Pennsylvania State, constitutes a denial of Equal Protection right, under the Fourteenth Amendment to the United States Constitution, in the absence of rational or compelling justification. 2. Whether the excessive and the arbitrary use of waiver doctrines in Pennsylvania, with particular reference to the Pennsylvania Rules of Appellate Procedure, (Pa.R.A.P.) 3051 in this case, resulting in sua sponte dismissal of appeals without reaching the merits, without notice, without adversarial review, or opportunity to be heard violates the Due Process Clause of the Fourteenth Amendment where a challenge to the jurisdiction of the trial court and other dispositive matters were already preserved and pending. 3. Whether a falsification of information to gain access into the electronic filing system of a court by an entity who is not a party to a case, but unilaterally substitutes itself for the defendant in the e-filing portal rises to the level of voiding the judgment obtained by the party under the Due Process Clause of the Fourteenth Amendment, especially where the act also amounts to a strict liability misdemeanor offense under the relevant state law.
