No question identified. : APPLICATION TO JUSTICE BRETT M. KAVANAUGH FOR THE EIGHTH CIRCUIT TO EXTEND TIME TO FILE PETITION FOR CERTIORARI (Sup. Ct. R. 13.5) RELIEF SOUGHT Patrick Miller Webb Jr., petitioner, pro se request(s) that Justice Brett M. Kavanaugh, Justice for the Fighth Circuit, extend the time for filing a petition for writ of certiorari to the United States Court of Appeals for the Eighth Circuit in the matter of United States of America v. Patrick Miller Webb Jr., case number 25-1154 for a period 60 days. GROUNDS FOR RELIEF Judgment Below 1. On March 10, 2021 petitioner was convicted by jury verdict to one count of "Distribution of a Controlled Substance Near a Protected Location" ; one count of "Possession of a Firearm in Furtherance of a Druf Trafficking Crime" ; one count of "Felon in Possession of a Firearm", in the United States District Court for the Northern District of Iowa. 2. On December 10, 202] petitioner duly appealed this conviction to the U.S. Court of Appeals for the Eighth Circuit. This Court affirmed the conviction by its order entered on June 12, 2023. 3. On September 10, 2024, petitioner filed his timely § 2255 motion. This motion was denied January 10, 2025. 4. On January 22, 2025, petitioner filed his Notice of Appeal. He He was denied C.O.A. on April 24, 2025 by the U.S. District Court of Appeals for the Eighth Circuit. 5. On dune 2, 2025, petitioner filed a Motion for Reconsideration taken as a Motion for Rehearing by Panel with the U.S. Court of Appeals for the Eighth Circuit and was denied July 7, 2025. See Exhibit A. Petitioner received the denial July 16, 2025. See Exhibit B. JURISDICTION The Supreme Court will have jurisdiction over this matter because 28 U.S.C. § 1254(1) gives the Court jurisdiction over an appeal of a final judgment of a United States Court of Appeals. REASONS WHY RELIEF FROM TIME LIMIT NEEDED Sea a NEEDED Under Supreme Court Rule 13.1, time for filing of a petition for writ of certiorari in this matter expires on October 7, 2025. Patrick Miller Webb Jr., petitioner, respectfully ask this Court for an extension of time to file his petition for writ of certiorari, because he represents himself pro se. Petitioner has no training in the field of law. Petitioner has written the Office of the Clerk to receive an "Guide for Prospective Indigent Petitioners for Writs of Certiorari" and the "Rules of the Supreme Court of the United States" book so he can study the book and rules and forms needed for a proper "writ of certiorari". Being confined in federal prison, petitioner works a regular full time job at the Federal Correctional Institution Ray Brook, with limited access to the law library. Petitioner needs the additional time to read the case laws and Supreme Court rulings to cite in his petition for writ of certiorari and he has to conduct his own research with no help in order to properly prepare his petition for writ of certiorari. This application for extension is made in the interest of justice and not Meant to delay the proceedings. PERSUASIVE GROUNDS FOR CERTIORARI IN THIS CASE The conviction and sentence of Petitioner raises grave Constitutional questions of the Fifth and Sixth Amendments to the Constitution of the United States. Petitioner prays the Court grants him an extension of time to file petition for writ of certiorari, due to the circumstances mentioned above. Petitioner is presently serving a 380 month sentence.
