Question Presented (AI Summary)

Whether a pro se litigant may obtain an extension of time to file a Supreme Court petition based on a pending administrative agency review and government shutdown

Question Presented (OCR Extract)

No question identified. : APPLICATION FOR AN EXTENSION IN TIME CASE No. 25-5113, Submitted Pro Se. To: Supreme Court of the United States, | received the Supreme Court's reply (10/6/25). That reply denied my motion to proceed in forma pauperis. The Court's denial is allowing me until October 27, 2025 to resubmit my appeal (after paying the required docketing fee and complying with Rule 33.1). While waiting for the U.S. Supreme Court’s most recent reply, | explored an alternate method to have my claim heard. The Equal Employment Opportunity Commission (EEOC) previously conducted a review of my case. | recently discovered an error in the EEOC’s review and sent them a letter exploring the possibility of having them reopen my case. In response to my inquiry, | received the following autoreply (10/2/25) from Adam Carvill of the EEOC (sent to me via email): “Thank you for your message. Due to the lapse of appropriations, the EEOC is currently closed and | am not available to respond to your message. | will return your email when the government reopens.” Thus, | will not receive a substantive reply from the EEOC until the government reopens. The EEOC'’s reply could seriously affect whether | need to appeal to U.S. Supreme Court. Because the EEOC cannot reply until the government reopens, | ask the US Supreme Court to extend my Supreme Court petition due date. When the government will reopen it is not known. Thus, | ask the Supreme Court to extend my resubmission deadline so that the deadline is at least 21 days following my receipt of a reply from the EEOC. Certificate of Service: | have submitted a copy of this Application to the opposing party’s attorney (Atty. Kawski). Thank you for considering this request, ew Dykmaw 10/13/25 @08)237 4733
