Question Presented (AI Summary)

Whether a state prison's library copy limit impermissibly burdens an incarcerated individual's constitutional right of access to the courts

Question Presented (OCR Extract)

No question identified. : APPLICATION TO EXTENL TIME TO FILE PETITION FOR WRIT OF CERTIORARI To the Honorable Justice Kavanaugh: COMES NOW Edward Allen Moore, 28 U.S.C. § 2254 Petitioner in the underlying cause and Applicant herein, with this motion to extend the time in which to petition the Court for writ of certiorari to the United States Court of Appeals for the Eighth Circuit from the denial of Applicant's application for a certificate of appealability, see attached July 28, 2025 Judgment, currently due December 3, 2025, see attached September 4, 2025 Order denying rehearing, and in support thereof would show as follows: RELIEF SOUGHT Applicant seeks a 60-day extension of time, up to and including February 1, 2026, to file a petition for writ of certiorari. GROUND FOR RELIEF Although nowhere to be found in Departmental. or institutional policy, the institution's librarian, with the acquiescence of Respondent Hancock, implemented a limit of 50 copies per week (Thursday mornings). See attached grievance. Purportedly, this de required, i.e., a document from a court specifying a deadline, is often lacking, e.g., the current deadline sub judice. Applicant estimates that, counting one copy for service and one copy for retention, his petition for writ of certiorari will require over 200 copies. Factoring in the upcoming holidays, even with a 60-day extention of time, it may be necessary to abbreviate the appendiz. CONCLUS TON WHEREFORE, premises considered, Applicant respectfully moves that the time for filing the petition for writ of certiorari to the United States Court of Appeals for the Eighth Circuit be extended to February 1, 2026. Respectfully submitted, Edward Allen Moore, Applicant pro se #185492 Southeast Correctional Center 300 East Pedro Simmons Drive Charleston, Missouri 63834 VERIFICATION I declare under penalty of perjury this intl, day of November, 2025 that all facts stated in the foregoing are true and the attachments are unaltered photocopies.
