Does the Sixth Circuit Court's split decision determining a statement by a party opponent to be hearsay directly contradict other Circuit Court decisions?
QUESTIONS PRESENTED This case involves the Petitioner’s disclosure of corruption within the Defendant City of Romulus’ Mayor’s office and her unlawful termination shortly thereafter. In a split decision the Sixth Circuit determined the Defendants’ statements were hearsay and failed to apply the Defendants’ statements. The questions presented are: 1. Does the Sixth Circuit Court’s split decision determining a statement by a party opponent to be hearsay directly contradict other Circuit Court decisions? 2. Is the Sixth Circuit Court of Appeals required to analyze statements they determine to be hearsay where motive and intent are at issue in accord with and pursuant to Fed. R. Evid. 803(3)?
