Extensive Case Law Exists in which Depression and Mental Illness have been accepted by the Courts and Governing Bodies as Valid and Legal Bases for the Application of Equitable Tolling, especially in the case of such Depression and Mental Iliness resulting from Age Discrimination and Retaliation. Congress drafts Statutes with Equitable Tolling as a Background Principle and Courts have therefore held that many different kinds of Deadlines may be Equitably Tolled. Therefore, the decisions made regarding the case of Professor Richard A. Frasca, Ph.D., should be overturned. 2. The Petitioner has a Constitutional Right to An Evidentiary Hearing, which have been denied to him in Federal Court. Evidentiary hearings regarding evidence vital to this case must be granted.
