Question Presented (AI Summary)

Whether a pro se litigant with documented cognitive and neurological impairments is entitled to reasonable accommodations and an extension of time to file a Supreme Court petition under the Americans with Disabilities Act

Question Presented (OCR Extract)

No question identified. : To the Honorable Elena Kagan, Associate Justice of the Supreme Court of the United States and Circuit Justice for the Ninth Circuit: Petitioner Orna Shaposhnik, proceeding pro se, respectfully applies pursuant to Supreme Court Rule 13.5 for an extension of time of sixty (60) days within which to file a petition for a writ of certiorari. 1. Judgment Sought to Be Reviewed The judgment sought to be reviewed is the order of the Supreme Court of California denying discretionary review, entered on September 24, 2025, and declared final forthwith, with no petition for rehearing permitted under California law. 2. Jurisdictional Basis This Court has jurisdiction under 28 U.S.C. § 1257(a). Absent an extension, the petition for a writ of certiorari is due on December 23, 2025. 3. Relief Requested Petitioner respectfully requests an extension of sixty (60) days, up to and including February 21, 2026, within which to file the petition for a writ of certiorari. 4. Good Cause for Extension Good cause exists for this extension. Petitioner is a self-represented litigant with documented cognitive and neurological impairments that substantially limit her ability to process information, sustain concentration, and prepare complex legal filings. Petitioner timely sought ADA accommodations in the state courts, which remained pending or unadjudicated while dispositive proceedings occurred. Preparation of a petition for a writ of certiorari requires substantial legal analysis, careful review of the record, and compliance with this Court’s formatting and filing requirements. Petitioner has been diligently working to prepare the petition but requires additional time to complete the filing without risking error or misunderstanding due to her medical limitations. This application is submitted in good faith, is not made for purposes of delay, and represents Petitioner’s first request for an extension of time in this matter. 5. Position of Respondents Petitioner has not sought the position of Respondents regarding this application. Given Petitioner’s pro se status and medical circumstances, Respondents’ position is unknown. CONCLUSION For the foregoing reasons, Petitioner respectfully requests that the Court grant this application and extend the time to file a petition for a writ of certiorari for sixty (60) days, to and including February 21, 2026. Respectfully submitted, Dated: December 15, 2025 /s/ Orna Shaposhnik Orna Shaposhnik Petitioner, Pro Se 18375 Ventura Blvd. No. 599 Tarzana, CA 91356 Telephone: 818-915-8292 Email: Annshapo@gmail.com
